Terms of Service
These Terms of Service (“Terms”) govern your access to and use of topicAI and all related services, features and content (the “Service”), provided by Topic AI (“we”, “us”). By accessing or using the Service you agree to these Terms on behalf of yourself and the organisation you represent.
1. The Service
The Service provides artificial intelligence–assisted tools, including document analysis, summarisation, drafting, comparison, property and planning data lookups, and retrieval-augmented question answering.
2. AI output is not advice
AI-generated output is provided for information and assistance only. It does not constitute legal, planning, valuation, financial or other professional advice and may be inaccurate, incomplete or out of date. You remain responsible for reviewing, verifying and exercising professional judgement on any output before relying on it or providing it to anyone else.
3. Accounts
You must provide accurate account information and keep log-in credentials secure. Your organisation is responsible for activity under its accounts and for the users it invites.
4. Your content
You keep ownership of all documents and data you upload. You grant us a limited, non-exclusive, non-transferable licence to host, process and analyse your content solely to provide, maintain and support the Service for you. We do not use your content to train AI models. You confirm you have the rights and any consents needed to upload content, including personal information about others.
5. Acceptable use
You must not use the Service unlawfully, upload malicious code, attempt to access other customers’ data, interfere with the Service’s operation, or resell the Service without our written agreement.
6. Trials, fees and usage
New subscriptions include a 30-day free trial. After the trial, plan fees are billed monthly in advance. Each plan includes a monthly allowance of AI token usage; usage beyond the allowance is charged at cost on the next invoice, up to the firm monthly maximum shown for your plan. Prices are in Australian dollars. You can cancel at any time, effective at the end of the current billing period.
7. Availability and support
We aim to keep the Service available and to fix problems promptly, but we do not guarantee uninterrupted or error-free operation except as agreed in a separate enterprise agreement.
8. Liability
Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded. To the extent permitted by law, our total liability arising from the Service is limited to the fees you paid in the three months before the claim, and we are not liable for indirect or consequential loss, or for decisions made in reliance on AI output.
9. Ending the Service
You may close your account at any time. We may suspend or end access if you materially breach these Terms. On closure you can export your content for a reasonable period before it is deleted.
10. Privacy
Our handling of personal information is described in our Privacy Policy.
11. Changes and governing law
We may update these Terms by posting a new version on this page and, for material changes, notifying account administrators. These Terms are governed by the laws of New South Wales, Australia.
